Terms and conditions

These terms govern your use of electrikkettle.com (the "Site"), operated by Electrik Kettle LLC ("Electrik Kettle," "we," "us," or "our"). By using the Site, you agree to these terms. If you don't agree, don't use the Site. These terms cover the Site itself. A signed engagement with us for marketing services is governed by that engagement's own agreement.

1. Changes to the Site or these terms

We can change, suspend, or discontinue any part of the Site at any time, and we can revise these terms as our services or the Site change. The date at the top reflects the most recent revision. Continued use of the Site after a change means you accept the updated terms.

2. Use of the Site

You may view and use the Site for its intended purpose: learning about our services, reading our blog, booking a call, and contacting us. We grant you a limited, non-exclusive, non-transferable license to do that. You may not copy, scrape, republish, or otherwise reuse the Site's content for commercial purposes without our written permission.

3. Prices and services shown

Prices on the Site are starting prices, shown as "from" a monthly amount. They describe our services and are not an offer you can accept through the Site. The scope and price of any engagement are set in a written agreement signed by both parties.

4. Results described on the Site

Results described on the Site come from specific past engagements. They show what happened in those cases and are not a promise of the same result for your business.

5. Intellectual property

The Site's content, including its text, graphics, logo, and design, is owned by Electrik Kettle or licensed to us, and is protected by copyright and trademark law. Nothing on the Site transfers any ownership or license to you beyond the limited use described in Section 2.

6. What you send us

If you submit information through our contact form, email signup, or booking calendar, you confirm it's accurate and that you have the right to share it with us. Don't submit false information, or content that's unlawful, abusive, or infringes someone else's rights. We handle what you submit according to our privacy policy.

7. Prohibited uses

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its underlying systems; interfere with the Site's normal operation, including with bots, scrapers, or automated scripts; or impersonate any person or business in your use of the Site.

8. Third-party links and services

The Site links to outside sources and uses outside services, including Google Calendar for booking. We don't control those sites or services and aren't responsible for their content, accuracy, or practices. A link isn't an endorsement.

9. Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. Blog posts are general information and are not advice for your specific business. We don't guarantee the Site will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, Electrik Kettle isn't liable for any indirect, incidental, or consequential damages arising from your use of the Site. Because the Site itself is a free informational resource, our total liability for any claim related to the Site is limited to $100. This limitation doesn't apply to a separate signed engagement for paid services, which is governed by that engagement's own terms.

11. Indemnification

You agree to defend and hold Electrik Kettle harmless from any claim arising out of your misuse of the Site or your violation of these terms.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these terms or the Site will be resolved in the state or federal courts located in Florida.
